1. INTRODUCTION

These general Terms and Conditions of Sale (“TCS”) govern all purchases from Khush Candle Co. LLC products, (“Products”), from the website www.khushcandle.com (“Website”).
In this TCS, “Customer” shall mean any person, consumer or non-professional, placing an order for Product(s) listed for sale on the Website.
Khush Candle Co. LLC reserves the right to amend or update the TCS at any time and without notice. Any changes to the TCS will only apply to orders placed on or after the effective date at which they were modified. In the event that the TCS is modified, such modifications shall not change the TCS that Customer had accepted at the time the order was made.
Any order placed on the Khush Candle Co. LLC online store (“Website”) constitutes full and complete acceptance of this TCS by the Customer making the purchase.
1.2 INFORMATION AND AVAILABILITY
1.2.1 Products Reserved Strictly for Personal Use
Khush Candle Co. LLC sells products online to consumers and non-professionals. Products are meant strictly for use by the Customer and not for resale. Khush Candle Co. LLC reserves the right to decline fulfillment of any order that appears to not be keeping with personal or non-professional needs. Khush Candle Co. LLC may impose restrictions on orders made by person(s), these include but are not limited to orders placed by or under the same account, the same card used to make multiple purchases, and/or orders that use the same billing and/or shipping address.
These restrictions may be applied irrespective of whether or not the order was initially validated via customer receipt.
1.2.2 Information Regarding the Products
Pictures of the products offered on the Website are described and presented as accurately as possible with respect to the following: specifications, illustrations, size, composition, etc. While Khush Candle Co. LLC makes every reasonable effort to present accurate and reliable information on this Website, pictures of the products shown on the website may not correspond to their actual appearance due to shadows, reflections etc. during photographing. Additionally, the products are “imperfectly perfect” due to each element of the candle being made by hand, organic and not commercially produced. Each product is unique, original and one of a kind.
1.2.3 Product Safety Information
Each of our products comes with instructions for use and care. When misused, a candle or candles can cause harm to persons and property. Khush Candle Co. LLC advises that each customer carefully read the instructions that is provided with the product. Khush Candle Co. LLC shall not be responsible for any damages or losses (“Held Harmless”) resulting from Customer(s) misuse of the product or failure to adhere to the instructions and safety protocols provided.
1.2.4 Changes Made to Products
Khush Candle Co. LLC reserves the right to change or discontinue a product or any of its features as set forth on the Website at any time and without notice. Notwithstanding orders already placed at the time of said change(s). During the purchase process, Khush Candle Co. LLC will notify Customers if the order cannot be processed due to certain product unavailability.
1.3 PRICES
Item prices will be displayed in USD ($), and do not take into account the shipping / delivery costs or taxes for the order. The Customer will be informed of shipping/ delivery costs, and applicable taxes during order summary pages /during checkout and before validation and payment of the order.
Khush Candle Co. LLC will make all reasonable efforts to ensure that the prices on the website for Products are accurate, however should an error occur and a product mispriced, Khush Candle Co. LLC at its sole discretion will either a) Process the order or b) ask the Customer whether they wish to purchase the Product at the correct price.
Khush Candle Co. LLC reserves the right to change product prices at any time and without notice, however such changes will not apply to products for which the customer has already received an order confirmation.
